Terms of Service for SnapFrame

Please read these Terms of Service ("Terms") carefully before using the SnapFrame website and services (the "Service") operated by SnapFrame ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Description of Service

SnapFrame provides a web-based tool that allows users to upload screenshots or other images and modify them by adding frames, backgrounds, effects, text overlays, watermarks, and other visual enhancements ("Beautified Images"). The core image processing occurs within the user's web browser. The Service is currently provided free of charge.

2. Use of the Service

• You agree to use the Service only for lawful purposes and in accordance with these Terms.
• You are solely responsible for the images you choose to process using the Service and for ensuring you have the necessary rights or permissions to use and modify those images.
• You agree not to use the Service:
  • To process or create any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • To infringe upon the intellectual property rights or other rights of any third party.
  • To attempt to gain unauthorized access to the Service, interfere with its security features, or disrupt its operation.
  • To reverse engineer, decompile, or disassemble any portion of the Service.

3. Intellectual Property

• The Service: We own all rights, title, and interest in and to the Service itself, including its design, software, code, branding, and look and feel ("SnapFrame IP"). These Terms do not grant you any rights to use the SnapFrame IP except as necessary to use the Service as permitted herein.
• Your Content: You retain full ownership and all intellectual property rights to the original images you upload to the Service. You also retain full ownership and rights to the Beautified Images you create using the Service.
• License Grant for Operation (Client-Side): By using the Service, you grant us a temporary, non-exclusive, royalty-free, worldwide license solely to process your image within your browser session as necessary to provide the Service's functionality (e.g., applying effects, generating the preview and the final downloadable image). This license terminates when you close your browser session or navigate away from the relevant page. We do not claim any ownership rights over your images or the Beautified Images you create.

4. Disclaimers

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.
• IMAGE PROCESSING OCCURS IN YOUR BROWSER. WHILE WE STRIVE FOR ACCURACY, WE ARE NOT RESPONSIBLE FOR ANY ERRORS, ARTIFACTS, OR UNEXPECTED RESULTS IN THE BEAUTIFIED IMAGES. YOU ARE RESPONSIBLE FOR REVIEWING THE FINAL OUTPUT.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNAPFRAME, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

6. Indemnification

You agree to defend, indemnify, and hold harmless SnapFrame and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

7. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by SnapFrame, such as the "Buy Me a Coffee" donation link. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that SnapFrame shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect (e.g., by posting on the website). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
